Application of Labour Laws to Gilgit Baltistan

The issue of leaves and holidays throughout Pakistan is governed by the Factories Act 1934. Gilgit Baltistan does not presently have its own Factories Act however in the absence of the same it has adopted the federal Factories Act 1934. Therefore leaves and holidays for employees working in GB are provided per the provisions of the Factories Act 1934.

Regarding Standing Orders which is the paramount labour law in Pakistan for workmen, GB does not have its own version of this law nor is it provided anywhere that GB has adopted the federal version of the Standing Orders. To cover this grey area we quote Section 4 of the Gilgit Baltistan Reforms Order 2019 provides that “rights of individuals to be dealt with in accordance with law, etc.- (1) To enjoy equal protection of law and to be treated in accordance with law is the inalienable right of every citizen, wherever he may be, and of every other person for the time being in Gilgit-Baltistan (2) In particular— (a) no action detrimental to the life, liberty, body, reputation or property of any person shall be taken except in accordance with law; (b) no person shall be prevented from or be hindered in doing that which is not prohibited by law; and 4 (c) no person shall be compelled to do that which the law does not require him to do.”

Going by the above provision of law all rights available to employees throughout Pakistan under the Standing Orders Ordinance should also be thus available to employees working in GB.
